Tax Refund Offset for Student Loans? How Bankruptcy Helps

Bankruptcy won’t automatically get rid of your student loans. But it likely can stop your tax refund from being offset for defaulted student loans.

Both chapter 7 and chapter 13 bankruptcy prevents your creditors from trying to collect from you.

So if you file bankruptcy after you got notice of the offset, but before your tax refund is scheduled to deposit, you may be able to keep all of your tax refund.
